Personal Data Protection Policy

Preamble

Baticlick is an organisation dedicated to helping Swiss citizens and society to be environmentally friendly. Its registered office is at Route de Longefont, 19, 1475 Autavaux, Switzerland. It is responsible for the data processing carried out when you browse, create an account or purchase an item from our website, or when you use our Baticlick platform.

Baticlick makes privacy and the protection of personal data a priority.

To help you better understand how we process your data and make informed choices about how we use it, we invite you to read on.

Baticlick undertakes to comply with all its obligations arising from the regulations applicable to the processing of personal data, in particular:

  1. Definitions

‘Personal data»: any information relating to a natural person who is identified or can be identified, directly or indirectly, by means of an identifier such as a name, telephone number, postal address, email address, identification number, location data, etc.

Baticlick has appointed Gaëtan Bio as Data Protection Officer. His role is to inform and advise the data controller, to ensure compliance with applicable regulations and, in particular, to ensure that individuals’ rights are respected.

  1. Processing carried out and legal basis

We use your data to:

create and manage your customer account (carrying out pre-contractual measures and performing the contract).

to manage and secure your payments (legal obligation) and to enable you to register your bank details if you wish (consent);

to ensure that your transactions run smoothly and to monitor your orders (performance of the contract).

to enable us to deal with your complaints to our customer service department, by email or by telephone (performance of the contract or legitimate interest if you are not a Member).

to respond to your requests for information via our contact forms (legitimate interest).

to ensure the security of the Platform, your data and your communications, in particular by moderating your comments and the content of your messages with other Members (legitimate interest).

to comply with the laws and regulations in force and with any decision by a competent judicial authority or any legal request (legal obligations).

We take all necessary precautions to ensure the security of your data.

We retain your data for as long as you remain active on our Platform.

In the event of prolonged inactivity lasting three years, or if you request the closure of your account, we will archive your account and retain the associated data for a period of 10 years so that we can comply with our legal obligations, in particular our tax obligations.

At the end of this 10-year period, we will anonymise and then delete your data. Your account and your data will then become inactive.

If you have created an account on our Platform but have not carried out any transactions (purchases or sales), your data will be anonymised and then deleted if you remain inactive for three years, or if you ask us to delete your account.

  1. How to exercise your rights

In accordance with the relevant regulations, you have the right to access, rectify, erase, object to, restrict and transfer your personal data.

Where processing is based on your consent, you may withdraw your consent at any time. In this case, the lawfulness of the processing carried out prior to the withdrawal will not be called into question.

If the legal basis for processing is legitimate interest, in accordance with Article 21 of the GDPR, you have the right to object at any time to the processing of your personal data on grounds relating to your particular situation.

Finally, you may provide us with your instructions regarding the retention, erasure and disclosure of your personal data in the event of your death.

In the interests of confidentiality and data protection, please write to us at the email address linked to your account.

For requests made by email or post, you will need to provide a copy of your ID.

Your request to exercise your rights will be dealt with within one month of receipt of the request. This period may be extended by two months, depending on the complexity or number of requests. You will be informed of this extension and the reasons for the delay within one month.

If you are not satisfied with our response, you may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC – Feldeggweg 1 CH – 3003 Bern).
